Contenuti | L’insegnamento ha ad oggetto il Diritto processuale civile, la cui disciplina è contenuta, in primo luogo, nel Codice di Procedura Civile. Le lezioni muovono dall’esame dei principi generali del processo civile affermati dalla Costituzione e dalle fonti sovranazionali, per poi passare all'esame delle Disposizioni generali contenute nel Libro I c.p.c. Le lezioni affrontano, inoltre, le singole forme di tutela giurisdizionale. In primo luogo la tutela di cognizione, in particolare il rito ordinario di cognizione, nelle varie fasi descritte dal Libro II del Codice, e il procedimento semplificato di cognizione. Questo studio è completato dall’esame dei principi generali delle impugnazioni e dei singoli mezzi di impugnazione. In questo modo l'insegnamento percorre i diversi gradi di un processo. |

Metodologie didattiche | Sono previste lezioni frontali, esercitazioni pratiche (con analisi della giurisprudenza) ed eventuali seminari. Agli studenti frequentanti saranno indicate, nel corso delle lezioni, letture di approfondimento su questioni giurisprudenziali, attraverso l’esame di casi pratici. |
Metodi di valutazione | Esame orale ed un eventuale colloquio preesame (per gli studenti frequentanti). |

Contents | The course focuses on civil procedural law, the regulation of which is contained, first and foremost, in the Code of Civil Procedure. The course begins with an overview of the general principles of civil proceedings as set out in the Constitution and supranational sources, and then moves on to an analysis of the general provisions contained in Book I of the Code of Civil Procedure. Furthermore, the course deals with the individual forms of judicial protection. First of all, the cognitive proceedings, in particular the ordinary procedure of cognition, in the various stages described in Book II of the Code, and the simplified procedure of cognition. This study is completed by an analysis of the general principles of appeals and the individual means of appeal. In this way the course covers the different stages of a trial. After the cognitive proceedings, the course deals with the other forms of judicial protection: enforcement protection (Book III of the Code of Civil Procedure) and interim precautionary and non precautionary protection (Book IV of the Code of Civil Procedure). The study of these two forms of judicial safeguard completes the student's civil procedural education. |

Teaching methods | There will be frontal lectures, practical exercises (with analysis of case law) and possible seminars. Attending students will be given in-depth readings on case law issues through the examination of practical cases during the course. |
Evaluation methods | An oral exam and a possible pre-examination colloquy (for attending students). |
