Il corso si propone l’obiettivo di tratteggiare il sistema delle fonti di produzione del diritto romano e la loro codificazione nel corso dell'età tardoantica.

Propedeuticità: Diritto romano e tradizione romanistica.

Didattica frontale con ampia partecipazione degli studenti ed esercitazione su testi giuridici romani. Lo studente può concordare con il docente lo svolgimento di una tesina su uno degli argomenti di programma.

L'esame si svolge in forma orale con eventuale discussione di una tesina redatta dallo studente previo accordo con il docente.

Durante il corso si provvederà a far conoscere agli studenti qualche manoscritto delle fonti di cognizione del diritto romano e le principali edizioni di fonti giuridiche.

Il Codice Teodosiano e le vicende della sua formazione. La presunta natura cristiana del Codice Teodosiano. I rapporti della prima codificazione ufficiale con il Codice Giustiniano. La legislazione dell'imperatore Giuliano: materiali per una palingenesi. La società tardoantica: medici e professori. L'organizzazione sanitaria in Roma imperiale: la Relatio XXVII di Simmaco e l'ordo successionis archiatrorum.

For a total of 200 pages.

The course aims to outline the system of sources of roman law and their codification during the late antiquity.

To access the examination, students must have passed, as required by the course pre-requisites, the following exam:
– Diritto romano e tradizione romanistica.

Frontal teaching with wide participation of students and practice exercises on Roman legal texts. The student can agree with the professor to carry out a thesis on one of the topics of the program.

The examination takes place in oral form with possible discussion of a thesis written by the student after agreement with the professor.

During the course, students will be introduced to some manuscripts of the sources of cognition of Roman law and the main editions of Roman legal sources.

The Theodosian Code and the events of its formation. The alleged christian nature of the Theodosian Code. The interconnections of the first official codification with the Justinian Code. The legislation of Emperor Julian: notes for a palingenesis. Late antiquity society: physcians and professors. Health organization in imperial Rome: Symmachus' Relatio XXVII and the ordo successionis archiatrorum.
