Contenuti | Il laboratorio “Intersectional discrimination e società multicuturali” è un corso di lezioni interdisciplinare con impostazione tecnico-pratica, incentrato sul tema del diritto antidiscriminatorio sia nazionale che comunitario. Obiettivo del laboratorio è far acquisire allo studente una conoscenza approfondita della tematica, attraverso un approccio “intersezionale”, che non consideri i fattori di discriminazione (etnica, razziale, religiosa, di genere, ecc.) isolatamente. In questa prospettiva si privilegerà il metodo comparativo, con precipua attenzione al rapporto tra diritto e religioni. |
Testi di riferimento | Il materiale di studio per il laboratorio sarà fornito durante il corso di lezioni. In ogni caso è previsto l’esame di casi tecnico-pratici, già posti all’attenzione della Corte di Giustizia e della Corte EDU. |
Obiettivi formativi | Il diritto antidiscriminatorio ha consentito ai Paesi membri dell’UE di potenziare la gamma degli strumenti giuridici per la promozione della parità e per il contrasto della diversità. Sotto questo profilo significativo è l’apporto del legislatore comunitario, soprattutto attraverso le direttive 2000/43/CE e 2000/78/CE, che, tuttavia, va declinato, all’interno delle odierne società multiculturali, in termini non soltanto di divieto di discriminazione, ma di approccio integrato alle discriminazione multiple. Il laboratorio “Intersectional discrimination e società multiculturali” è quindi orientato a formare nuove generazioni di giuristi e responsabili di diversity management. che saranno in futuro impegnati sulla gestione di tali tematiche. |

Contents | The 'Intersectional discrimination and multicultural societies' workshop is an interdisciplinary lecture course with a technical-practical approach, focusing on the topic of both national and EU anti-discrimination law. The aim of the workshop is to provide students with an in-depth knowledge of the theme through an 'intersectional' approach, which does not consider discrimination factors (ethnic, racial, religious, gender, etc.) in isolation. In this perspective, the comparative method will be favoured, with a focus on the relationship between law and religions. |
Textbook and course materials | Study material for the workshop will be provided during the course of the lectures. In any case, the examination of technical-practical cases, which have already been brought to the attention of the European Court of Justice and the European Court of Human Rights, is planned. |
Course objectives | Anti-discrimination law has enabled EU member states to strengthen the range of legal instruments for promoting equality and combating diversity. Significant in this respect is the contribution of the EU legislator, especially through directives 2000/43/EC and 2000/78/EC, which, however, must be declined within today's multicultural societies, in terms not only of the prohibition of discrimination, but of an integrated approach to multiple discrimination. The workshop 'Intersectional discrimination and multicultural societies' is therefore geared towards training new generations of lawyers and diversity managers who will be involved in the future in dealing with these issues. |
