Contenuti | L'insegnamento si propone di fornire un quadro giuridico completo del complesso rapporto tra diritto e religione, attraverso l’analisi in chiave interculturale dei seguenti aspetti: religioni, Costituzione, laicità e libertà nell’esperienza giuridica; esperienza giuridica e multireligiosità interculturale; le forme organizzative religiose tra normativa “pattizia”, diritto comune e diritto vivente; il patrimonio e le dinamiche finanziarie degli enti religiosi; le osservanze religiose tra diritti confessionali e ordinamento statale; la tutela delle identità, dati sensibili e interessi religiosi; libertà religiosa e profili bioetici; la tutela “positiva” della libertà religiosa; matrimoni religiosi e trascrizione nei registri dello stato civile; matrimonio e processo tra ordinamento statale e ordinamento canonico; matrimonio, unioni civili e convivenze tra ordinamenti confessionali e dinamiche interculturali; libertà religiosa e profili di diritto interculturale nella famiglia. |

Obiettivi formativi | Obiettivo dell'insegnamento è consentire l’acquisizione da parte dello studente di conoscenze approfondite in chiave interculturale della disciplina giuridica del fattore religioso. Lo studente sarà messo in grado di conoscere e comprendere gli istituti, i principi e le regole oggetto dell’insegnamento, non solo da un punto di vista squisitamente teorico, ma anche nella loro applicazione pratica, anche, se del caso, in una prospettiva critica. |

Metodologie didattiche | L'insegnamento si articola in lezioni e interattive della durata di 54 ore totali. È incentivata in aula la discussione dei temi affrontati, l’analisi di casi pratici e le esercitazioni di gruppo durante lo svolgimento del corso, mirano a rafforzare e a consolidare nozioni e concetti trasmessi dal docente nel corso delle lezioni. |
Metodi di valutazione | Per gli studenti frequentanti e non frequentanti è prevista una prova orale con votazione in trentesimi. L’esame consiste in un colloquio per accertare i livelli di conoscenza delle materie, di padronanza del linguaggio specialistico e la capacità di sviluppare un ragionamento volto all’applicazione delle conoscenze teoriche ai casi concreti. Il colloquio consiste in un minimo di cinque domande. La valutazione avverrà sulla base dei seguenti criteri: eccellente 30-30 e lode: lo studente dimostra ottima conoscenza degli argomenti, ottima proprietà di linguaggio, ottima capacità analitica. Molto buono 26-29: lo studente dimostra buona conoscenza degli argomenti, buona proprietà di linguaggio, buona capacità analitica. Buono 24-25: lo studente dimostra conoscenza di base dei principali argomenti, discreta proprietà di linguaggio. Soddisfacente 21-23: lo studente non mostra piena padronanza degli argomenti principali dell’insegnamento, pur possedendone le conoscenze fondamentali. Sufficiente 18-20: lo studente ha una conoscenza minima degli argomenti principali dell’insegnamento e del linguaggio tecnico. Insufficiente: lo studente non possiede una conoscenza accettabile dei contenuti dei diversi argomenti in programma. |

Contents | The teaching aims to provide a complete legal framework of the complex relationship between law and religion, through the intercultural analysis of the following aspects: religions, Constitution, secularism and freedom in legal experience; juridical experience and intercultural multi-religiousness; the religious organizational forms between "pattizia" legislation, common law and living law; the heritage and financial dynamics of religious bodies; religious observances between confessional rights and state order; the protection of identities, sensitive data and religious interests; religious freedom and bioethical profiles; the "positive" protection of religious freedom; religious marriages and transcription in the register of marital status; marriage and process between the state system and the canonical order; marriage, civil unions and cohabitation between confessional and intercultural dynamics; religious freedom and profiles of intercultural law in the family. |

Course objectives | The aim of the teaching is to enable the student to acquire in-depth knowledge in an intercultural key of the legal discipline of the religious factor. The student will be enabled to know and understand the institutes, principles and rules of the teaching, not only from an exquisitely theoretical point of view, but also in their practical application, also, if necessary, in a critical perspective. |
Prerequisites | It is necessary to have taken the exam of public and constitutional law. |
Teaching methods | The teaching is divided into lessons and interactive sessions lasting 54 hours. The discussion of the topics addressed, the analysis of practical cases and group exercises during the course is encouraged in the classroom, aimed at strengthening and consolidating concepts and concepts transmitted by the teacher during the lessons. |
Evaluation methods | For students attending and not attending an oral exam is scheduled with a score in thirtieths. The exam consists of an interview to ascertain the levels of knowledge of the subjects, the mastery of the specialized language and the ability to develop a reasoning aimed at the application of theoretical knowledge to concrete cases. The interview consists of a minimum of five questions. The evaluation will be based on the following criteria: excellent 30-30 and praise: the student demonstrates excellent knowledge of the subjects, excellent language properties, excellent analytical skills. Very good 26-29: the student demonstrates good knowledge of the subjects, good language skills, good analytical skills. Good 24-25: the student demonstrates basic knowledge of the main topics, discreet properties of language. Satisfactory 21-23: the student does not show full mastery of the main topics of teaching, even though he possesses the fundamental knowledge. Sufficient 18-20: the student has a minimum knowledge of the main topics of teaching and technical language. Insufficient: the student does not possess an acceptable knowledge of the contents of the different topics in the program. |
Other information | The program, the texts adopted and the methods of verification are the same for both attending and non-attending students. Attending students can take an intermediate test on the first part of the course concerning the following aspects: Religions and Constitution: secularism and freedom in legal experience; The religious organizational forms between "pattizia" legislation, common law and living law; The heritage and financial dynamics of religious bodies; Religious observances between confessional rights and state ordering. A final test will follow on the following aspects: Protection of identities, sensitive data and religious interests; Religious freedom and bioethical profiles; The "positive" protection of religious freedom; Religious marriages and transcription in the registers of civil status; Marriage and process between the state system and the canonical order; Marriage, civil unions and cohabitation between confessional and intercultural dynamics; Religious freedom and profiles of intercultural law in the family. |
