Il laboratorio si compone di 14 incontri della durata di tre ore ciascuno ed è strutturato in quattro moduli, la cui frequenza è obbligatoria (numero di assenze ammesse: 2). Esso si prefigge di offrire agli studenti conoscenze, competenze e abilità in materia di diritto sportivo europeo, attraverso lo studio diretto delle fonti rilevanti nell’ambito di due specifiche organizzazioni internazionali operanti nella regione europea: l’Unione europea ed il Consiglio d’Europa.
In particolare, muovendo dall’analisi della rilevanza dello sport nel diritto primario dell’Unione europea e dallo studio delle competenze dell’UE in materia sportiva, ci si soffermerà sugli interventi delle istituzioni europee in tale settore, per comprenderne la portata e le ricadute sul diritto interno. Attenzione particolare sarà dedicata alla protezione dei diritti fondamentali dell’atleta nello spazio europeo, attraverso l’approfondimento della casistica di riferimento sia della giurisprudenza della Corte di giustizia dell’Unione europea che della Corte europea dei diritti dell’uomo. Un modulo apposito sarà dedicato allo studio del fenomeno sportivo nel mercato interno ed alla connessa giurisprudenza della Corte di giustizia, nonché a profili legati alla più stringente attualità.

I materiali didattici saranno forniti ai partecipanti durante gli incontri.

Al termine del laboratorio, lo studente sarà in grado di conoscere, comprendere ed interpretare la complessità della normativa sportiva articolata su livelli diversi da quello nazionale.

Sono previste lezioni partecipate, studio di casi pratici, apprendimento cooperativo, seminari con esperti del settore, visione e discussione di film sui temi oggetto del laboratorio.

La prova finale consisterà in una presentazione orale su un tema a scelta dello studente e discusso in classe. Ai fini del conseguimento dell’idoneità, verranno valutate le capacità dello studente di orientarsi nella materia complessiva, di creare collegamenti critici, di utilizzare il lessico specialistico e di curare l’organizzazione del discorso.

Il laboratorio si svolgerà da febbraio a maggio 2025, il venerdì, dalle 10.30 alle 13.30, presso la sede di Palazzo Melzi, nello studio n. 16, salvo ove comunicato diversamente.

The laboratory consists of 14 meetings, lasting three hours each, and is structured into four modules. Attendance is mandatory (maximum number of absences: 2). It aims to offer knowledge, skills and abilities in the field of European sports law, through the study of the relevant sources within two specific international organizations operating in the European legal space: the European Union and the Council of Europe. In particular, the starting point of the analysis will be EU primary law and the related competences in sports matters. The focus will lie on the actions and initiatives of the European institutions in the field of sports in order to understand their scope and repercussions on the domestic law. Particular attention will be paid to the protection of the athlete’s fundamental rights in the European legal space, through an in-depth study of the case-law of both the Court of Justice of the European Union and the European Court of Human Rights. A specific module will be devoted to the analysis of sports’ legal issues in the internal market and the related case-law of the Court of Justice as well as of the most pressing current events.

Laboratory's materials will be provided at each meeting.

At the end of the laboratory, students will be able to know, understand and interpret the complexity of sports legislation and case-law at international regional European levels.

The following activities will be part of the laboratory: Participatory lessons, practical case studies, cooperative learning, seminars with experts, and discussion of films/documentaries.

The final test will consist of an oral presentation on a topic chosen by each student and discussed in class. The following students’ skills will be assessed: to approach critically the overall subject, to create critical connections, and to use specialized vocabulary.

The workshop will take place from February to May 2025, each Friday, from 10.30 am to 13.30 pm, at the Palazzo Melzi headquarters, room n. 16, unless otherwise communicated.
