L'insegnamento ha ad oggetto il sistema di giustizia sportiva. A tal fine, il corso esamina i soggetti della giustizia sportiva, gli organi di giustizia sportiva e i procedimenti della giustizia sportiva. Particolare attenzione sarà attribuita anche al rapporto tra giustizia sportiva e giurisdizione statale, al rapporto con i sistemi di giustizia sportiva e di arbitrato sovranazionali, considerando soprattutto il ruolo rivestito dal TAS/CAS di Losanna nel sistema di giustizia sportiva e di arbitrato.

Per lo studio della parte relativa ai sistemi di giustizia sportiva e di arbitrato sovranazionali e al TAS/CAS di Losanna il materiale sarà fornito direttamente dal docente.

L’insegnamento intende fornire, con un approccio anche pratico all’esame della materia, le conoscenze necessarie per comprendere il complessivo sistema della giustizia sportiva e dell'arbitrato sportivo in ambito federale, esofederale ed in ambito sovranazionale. Alla fine del corso gli Studenti sapranno individuare i soggetti della giustizia sportiva, la disciplina degli organi di giustizia sportiva e dei procedimenti della giustizia sportiva; i rapporti tra giustizia sportiva e giurisdizione statale, i sistemi di giustizia sportiva e di arbitrato sovranazionali, considerando soprattutto il ruolo rivestito dal TAS/CAS di Losanna.

Nessuna propedeuticità.

Sono previste lezioni frontali, eventuali seminari ed esercitazioni. Agli studenti frequentanti potranno essere indicate, nel corso delle lezioni, letture di approfondimento su tematiche specifiche.

L’esame finale consiste in un colloquio orale sugli argomenti trattati durante il corso e inseriti nel programma di studio, oltre che sulle fonti regolamentari e giurisprudenziali fornite dal docente.
Saranno valutate, oltre alla preparazione sui singoli istituti oggetto delle domande di esame, l’utilizzazione del lessico specialistico, la capacità di compiere collegamenti critici e di organizzare in modo logico l’esposizione.
La prova orale si prefigge l’obiettivo di accertare le capacità appena descritte e di accertare il livello di apprendimento dei temi oggetto del programma di studio. Il colloquio orale avrà, di regola, una durata di circa trenta minuti.
La valutazione finale è espressa in trentesimi.
E' previsto, per gli studenti frequentanti, un eventuale colloquio preesame.

Per la preparazione dell'esame è indispensabile la consultazione delle fonti dell'ordinamento sportivo che saranno indicate dal docente.

The focus of the course is the sports justice system. To this end, the course examines the subjects of sports justice, the bodies of sports justice and sports justice proceedings. Particular attention will be paid also to the relationship between sports justice and state jurisdiction, and to the relationship with supranational sports justice and arbitration systems, considering above all the role played by the CAS in Lausanne in the sports justice and arbitration system.

For the study of the part relating to supranational sports justice and arbitration systems and the CAS of Lausanne the material will be provided directly by the professor.

The course aims to provide, with a practical approach to the examination of the matter, the knowledge required to understand the overall system of sports justice and sports arbitration in the federal, extra-federal and supranational context. At the end of the course, students will be able to identify the subjects of sports justice, the discipline of sports justice bodies and sports justice proceedings; the relationship between sports justice and state jurisdiction, sports justice and supranational arbitration systems, with particular consideration given to the role played by the CAS in Lausanne.

No propaedeuticity.

There will be frontal lectures, possible seminars and tutorials. Attending students may be given in-depth readings on specific topics during the lectures.

The final exam consists of an oral exam on the topics covered during the course and included in the syllabus, as well as the regulatory and jurisprudential sources provided by the professor.
In addition to the knowledge of the specific institutes covered by the exam questions, the use of specialised vocabulary, the ability to make critical connections and to organise the exposition logically will be assessed.
The aim of the oral examination is to test the skills just described and to assess the level of knowledge of the topics included in the syllabus.
The oral examination will normally last about thirty minutes.
The final assessment is expressed in thirtieths.
A possible pre-examination colloquy is planned for attending students.

For the preparation of the exam, it is essential to consult the sources of sports law that will be indicated by the professor.
