GENNARO FRANCIOSI, Corso storico istituzionale di diritto romano, Giappichelli editore, Torino 2014 (limitatamente alla parte seconda, dalla quale sono esclusi il capitolo primo "Nozioni giuridiche di riferimento", il capitolo quarto "La successione ereditaria", i paragrafi da 13 a 21 del capitolo quinto "La proprietà e i iura in re aliena" ed i paragrafi da 15 a 26 del capitolo sesto "Le obbligazioni").

PER L'INSEGNAMENTO FONDAMENTALE (12 CFU)
Il corso intende indirizzare lo studente all’apprendimento del linguaggio e dei principali concetti giuridici nella consapevolezza che il diritto è fenomeno essenzialmente storico e che pertanto la plurisecolare vicenda della società romana antica, considerata sotto il privilegiato angolo visuale dell’origine e degli sviluppi degli istituti privatistici, possa ancora oggi rivelarsi, attraverso un’adeguata e critica comparazione diacronica, guida feconda per una migliore intelligenza del diritto privato attualmente vigente nei Paesi di tradizione romanistica.

PER L'INSEGNAMENTO FACOLTATIVO (6 CFU)
Il corso si propone l’obiettivo di consentire allo studente l’approfondimento del linguaggio e dei principali concetti giuridici nella consapevolezza che il diritto è fenomeno essenzialmente storico e che pertanto la plurisecolare vicenda della società romana antica, considerata sotto il privilegiato angolo visuale dell’origine e degli sviluppi degli istituti privatistici, possa ancora oggi rivelarsi, attraverso un’adeguata e critica comparazione diacronica, guida feconda per una migliore intelligenza delle moderne dinamiche giuridiche.

È prevista la propedeuticità di Diritto romano e tradizione romanistica.

PER L'INSEGNAMENTO FONDAMENTALE (12 CFU)
L'esame si svolge in forma orale.
Ai fini del superamento dell’esame, lo studente dovrà dimostrare di aver acquisito i principali concetti relativi all’ambito giusprivatistico, di saper utilizzare il relativo linguaggio specialistico ed inquadrare i singoli istituti nel loro contesto storico. La valutazione, espressa in trentesimi, terrà conto altresì della qualità espositiva e della capacità dello studente di operare gli opportuni collegamenti tra i diversi argomenti di studio. I differenti livelli di preparazione porteranno ad una valutazione: eccellente (30 e lode), ottima (28-30/30), buona (25-27/30), discreta (21-24/30), sufficiente (18-20/30).

PER L'INSEGNAMENTO FACOLTATIVO (6 CFU)
L'esame si svolge in forma orale.
È possibile concordare con la docente uno specifico argomento del programma sul quale lo studente potrà elaborare una tesina da discutere in sede d’esame.

Durante il corso sarà fornito agli studenti ulteriore materiale didattico.

PER L'INSEGNAMENTO FONDAMENTALE (12 CFU)
Parte generale:
1. L’esperienza giuridica romana e le sue ‘periodizzazioni’. Le fonti del diritto (di produzione e di cognizione).
2. Le nozioni giuridiche di riferimento: il rapporto giuridico; i soggetti giuridici; gli oggetti e le loro partizioni; i fatti e gli atti giuridici; il negozio giuridico.
3. Il processo civile.
4. Famiglia e persone: i gruppi familiari ed i caratteri della famiglia romana; lo status di schiavo; lo status di cittadino.
5. La successione ereditaria: la successione legittima e la successione testamentaria; la posizione giuridica dell’erede; l’acquisto dell’eredità; la tutela processuale dell’eredità.
6. La proprietà: caratteristiche e modi di acquisto; la tutela processuale del diritto di proprietà. Il possesso e la detenzione. I diritti reali di godimento e i diritti reali di garanzia.
7. Le obbligazioni: nozione di "obligatio" e suo sviluppo storico; le fonti dell’obbligazione; i soggetti e l’oggetto dell’obbligazione; i modi di estinzione dell’obbligazione.
Parte speciale:
1. La condizione sociale e giuridica degli atleti nel mondo romano.
2. La disciplina giuridica delle manifestazioni sportive nella legislazione imperiale.

The theaching aims to direct the student to learn the language and the main legal concepts in the awareness that law is an essentially historical phenomenon and that therefore the centuries-old story of ancient Roman society, considered under the privileged angle of view of the origin and developments of private institutions, may still prove today, through an adequate and critical diachronic comparison, a fruitful guide for a better understanding of the private law currently in force in the countries of the Roman tradition.

Student must have passed the exam of Diritto romano e tradizione romanistica.

Lectures and seminars dedicated to specific topics of the program.

FOR FUNDAMENTAL TEACHING (16 CFU)
The exam takes place in oral form. For the purpose of passing the exam, the student must demonstrate that he has acquired the main concepts relating to the field of private law, that he knows how to use the relative specialized language and to frame the various institutions in their historical context. The evaluation, expressed out of thirty, will also take into account the quality of exhibition and the ability of the student to make the appropriate connections between the different subjects of study. The different levels of preparation will lead to an evalutation: excellent (30 e lode), very good (28-30/30), good (25-27/30), fair (21-24/30), sufficient (18-20/30).

FOR OPTIONAL TEACHING (6 CFU)
The exam takes place in oral form. It’s possible to agree with the teacher a specific topic of the program on which the student can elaborate a paper to be discussed during the exam.

During the course, students will be provided with additional teaching material.

1. The Roman legal experience and its “periodizations”. The sources of law (of production and knowledge).
2. The legal notions of reference: the legal relationship; legal entities; legal objects and their partitions; legal facts and legal acts; the legal transaction.
3. The civil trial.
4. Family and persons: family groups and the characters of the Roman family; the status of slave; the status of citizen.
5. The hereditary succession: legitimate succession and testamentary succession; the legal position of the heir; the purchase of the inheritance; the procedural protection of the inheritance.
6. The ownership: characteristics and methods of acquisition; the procedural protection of the right of ownership. Possession and detention. The real rights of enjoyment and the real rights of guarantee.
7. The obligations: the notion of “obligatio” and its historical development; the sources of the obligation; the subjects and the objects of the obligation; the ways of extinguishing the obligation.
Special part:
1. The social and legal status of athletes in the Roman world.
2. The legal discipline of sporting events in imperial legislation.
